Please read these Terms of Service carefully before using the Portray AI portrait generation platform operated by Portray Inc.
1. Acceptance of Terms
By accessing or using the Portray platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.
2. Description of Service
Portray provides an AI-powered portrait generation service that transforms user-uploaded photographs into artistic portraits in various styles. The service includes free previews with watermarks, paid high-resolution digital downloads, and optional premium print ordering. All AI-generated content is created algorithmically and may vary in quality and accuracy.
3. Account Registration
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. User Content & Uploads
You retain ownership of all photos you upload to our platform. By uploading content, you grant Portray a limited, non-exclusive license to process your photos solely for the purpose of generating your requested portraits. You represent and warrant that you have the right to upload all content and that it does not violate any third party's rights or applicable laws.
5. Intellectual Property
Upon purchase, you receive a perpetual, worldwide, non-exclusive license to use your generated portrait for personal and commercial purposes. The Portray platform, including its AI models, algorithms, interface design, and branding, remains the exclusive property of Portray. You may not reverse engineer, copy, or redistribute any part of our technology.
6. Payments & Pricing
All prices are listed in USD and are subject to change without prior notice. Payment is processed securely through our third-party payment provider. By making a purchase, you agree to pay all fees associated with your order. Taxes may apply depending on your jurisdiction and will be calculated at checkout.
7. Free Preview & Generation Limits
Free accounts receive a limited number of portrait generations per day. Free previews are provided with watermarks at reduced resolution. These limits may be adjusted at our discretion. Abuse of the free tier, including creating multiple accounts to circumvent limits, may result in account suspension.
8. Prohibited Uses
You may not use Portray to generate portraits of individuals without their consent, create defamatory, obscene, or illegal content, upload content depicting minors in inappropriate contexts, attempt to circumvent security measures or usage limits, use automated tools to scrape or bulk-access the service, or resell or redistribute the service itself.
9. Limitation of Liability
Portray is provided "as is" without warranties of any kind. We do not guarantee that generated portraits will meet your specific expectations. To the maximum extent permitted by law, Portray shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. Any purchased portraits already downloaded remain subject to the license granted at purchase.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware.
